Exercise psychology encompasses the disciplines of psychiatry, clinical and counseling psychology, health promotion, and the movement sciences. This emerging field involves diverse mental health issues, theories, and general information related to physical activity and exercise. Numerous research investigations across the past 20 years have shown both physical and psychological benefits from physical activity and exercise. Exercise psychology offers many opportunities for growth while positively influencing the mental and physical health of individuals, communities, and society. However, the exercise psychology literature has (...) not addressed ethical issues or dilemmas faced by mental health professionals providing exercise psychology services. This initial discussion of ethical issues in exercise psychology is an important step in continuing to move the field forward. Specifically, this article will address the emergence of exercise psychology and current health behaviors and offer an overview of ethics and ethical issues, education/training and professional competency, cultural and ethnic diversity, multiple-role relationships and conflicts of interest, dependency issues, confidentiality and recording keeping, and advertisement and self-promotion. The word ‘cosmopolitan’, which derives from the Greek word kosmopolitês (‘citizen of the world’), has been used to describe a wide variety of important views in moral and socio political philosophy. The nebulous core shared by all cosmopolitan views is the idea that all human beings, regardless of their political affiliation, do (or at least can) belong to a single community, and that this community should be cultivated. Different versions of cosmopolitanism envision this community in different ways, some focusing on (...) political institutions, others on moral norms or relationships, and still others focusing on shared markets or forms of cultural expression. The philosophical interest in cosmopolitanism lies in its challenge to commonly recognized attachments to fellow citizens, the local state, parochially shared cultures, and the like. (shrink)

During the 1780s, as Kant was developing his universalistic moral theory, he published texts in which he defended the superiority of whites over non-whites. Whether commentators see this as evidence of inconsistent universalism or of consistent inegalitarianism, they generally assume that Kant's position on race remained stable during the 1780s and 1790s. Against this standard view, I argue on the basis of his texts that Kant radically changed his mind. I examine his 1780s race theory and his hierarchical conception of (...) the races, and subsequently address the question of the significance of these views, especially in the light of Kant's own ethical theory. I then show that during the 1790s Kant restricts the role of the concept of race, and drops his hierarchical account of the races in favour of a more genuinely egalitarian and cosmopolitan view. Post-modernism offers a revolutionary approach to the study of society: in questioning the validity of modern science and the notion of objective knowledge, this movement discards history, rejects humanism, and resists any truth claims. In this comprehensive assessment of post-modernism, Pauline Rosenau traces its origins in the humanities and describes how its key concepts are today being applied to, and are restructuring, the social sciences. Serving as neither an opponent nor an apologist for the movement, she cuts through post-modernism's (...) often incomprehensible jargon in order to offer all readers a lucid exposition of its propositions. Rosenau shows how the post-modern challenge to reason and rational organization radiates across academic fields. For example, in psychology it questions the conscious, logical, coherent subject; in public administration it encourages a retreat from central planning and from reliance on specialists; in political science it calls into question the authority of hierarchical, bureaucratic decision-making structures that function in carefully defined spheres; in anthropology it inspires the protection of local, primitive cultures from First World attempts to reorganize them. In all of the social sciences, she argues, post-modernism repudiates representative democracy and plays havoc with the very meaning of "left-wing" and "right-wing." Rosenau also highlights how post-modernism has inspired a new generation of social movements, ranging from New Age sensitivities to Third World fundamentalism. In weighing its strengths and weaknesses, the author examines two major tendencies within post-modernism, the largely European, skeptical form and the predominantly Anglo-North-American form, which suggests alternative political, social, and cultural projects. When the Global Financial Crisis hit, major political economists were able to boast that they had long warned that "crazy times" were coming. By contrast, leading sociologists seem to have been wrong footed. Totalizing narratives of a new "risk society", "second modernity" and the like appeared to have sacrificed the grounds for weighing up the costs and damages of contemporary capitalism. Made famous by Karl Polanyi, the concept of the embedded market suggests a differentiated diagnosis of our times that should (...) allow sociology to re-enter the discussion as a critic of an ideological attempt to block public discussions about losses and dam ages of contemporary capitalism. In this seminal exploration of the nature and future of African philosophy, Paulin J. Hountondji attacks a myth popularized by ethnophilosophers such as Placide Temples and Alexis Kagame that there is an indigenous, collective African philosophy, separate and distinct from the Western philosophical tradition. Hountondji contends that ideological manifestations of this view that stress the uniqueness of the African experience are protonationalist reactions against colonialism conducted, paradoxically, in the terms of colonialist discourse.

In the present book, Pauline Phemister argues against traditional Anglo-American interpretations of Leibniz as an idealist who conceives ultimate reality as a plurality of mind-like immaterial beings and for whom physical bodies are ultimately unreal and our perceptions of them illusory. Re-reading the texts without the prior assumption of idealism allows the more material aspects of Leibniz's metaphysics to emerge. Leibniz is found to advance a synthesis of idealism and materialism. His ontology posits indivisible, living, animal-like corporeal substances as (...) the real metaphysical constituents of the universe; his epistemology combines sense-experience and reason; and his ethics fuses confused perceptions and insensible appetites with distinct perceptions and rational choice. In the light of his sustained commitment to the reality of bodies, Phemister re-examines his dynamics, the doctrine of pre-established harmony and his views on freedom. The image of Leibniz as a rationalist philosopher who values activity and reason over passivity and sense-experience is replaced by the one of a philosopher who recognises that, in the created world, there can only be activity if there is also passivity; minds, souls and forms if there is also matter; good if there is evil; perfection if there is imperfection. This paper discusses how major changes in methodology, ideology and the points of view of researchers have given linguistics a new opportunity to study animal semiotics and return to the “animal language” question. The article presents new linguistic perspectives from language theory but also from sociolinguistics, language development studies or the study of sign language. This paper shows how these perspective changes have scientifically modified the way linguists approach animal communication and cleared a path for new study fields such as (...) biosemiotics and zoosemiotics. The second part of this article introduces other significant evolutions in various scientific fields, such as biology, neuroscience or ethology, but also philosophy, and how these changes are going in the same directions as linguistics’. It demonstrates how animal linguistics is without doubt a completely interdisciplinary subject where efficient research is only possible by paradigm changes in all related fields. The work of seventeenth-century polymath Gottfried Wilhelm Leibniz has proved inspirational to philosophers and scientists alike. In this thought-provoking book, Pauline Phemister explores the ecological potential of Leibniz’s dynamic, pluralist, panpsychist, metaphysical system. She argues that Leibniz’s philosophy has a renewed relevance in the twenty-first century, particularly in relation to the environmental change and crises that threaten human and non-human life on earth. Pauline Chazan draws upon psychology, r ral philosophy and literary interpretation to rebut the view that morality's role is to limit desire and control self-love. Perserving the ancients' connection between what is good for the self and what is morally good, Chazan argues that a certain kind of care for the self is central to moral agency. Her intriguing argument begins with a critical examination of the (...) views of Hume, Rousseau and Hegel. The constructive part of the book takes a more unusual turn by synthesising the work on the analyst Heinz Kohut and Aristotle into Chazan's own positive account, which is then illustrated by the use of Russian literature. Philosophy of science has characterized scientific knowledge as fundamentally propositional . This account leads to an inability to recognize and articulate the significant role of non-propositional, visual representation in the practice of science. Toward the development of a more productive framework for understanding visual representation in science, the present study critiques the standard philosophical view, reviews the literature on visual representation in science, and examines the scientific case of neuroscience. Specifically, the study looks at current research known as "functional mapping (...) of the human brain" which uses neuroimaging technologies such as positron emission tomography in the localization of particular functions in the human brain. This case study suggests that, contrary to previous accounts in philosophy of science, visual representation and propositional representation work together as parallel, interacting, interwoven practices in the discovery/construction of scientific knowledge. Visual representations are not reduced to--translated into--linguistic and mathematical propositions, but instead are used in their multidimensional forms. The present study focuses on the external, materialized visual representations used in the practice of science, as opposed to internal, mental images that might be studied by cognitive psychology. Several hypotheses are proposed which describe aspects of the role of these visual representations in the practice of science. These include the following: a primary function of visual representation is the representation of structure which is made possible by the use of actual space in the process of visual representation; visual comparisons among visual representations of real objects and processes, visual representations of theoretical models, and visual representations of integrations of the two are used to assess the fit of the theoretical models to the real objects and processes; the construction of visual prototypes or prototypical visual representations of objects of scientific research are used to categorize and stabilize--hold stationary for the purposes of scientific examination--such objects; and the construction of material models make it possible for scientists to interact with and/or manipulate materialized structures as representations of real systems. Kant is famous for his universalist moral theory, which emphasizes human dignity, equality, and autonomy. Yet he also defended sexist and (until late in his life) racist views. In this essay, I address the question of how current readers of Kant should deal with Kant’s sexism and racism. I first provide a brief description of Kant’s views on sexual and racial hierarchies, and of the way they intersect. I then turn to the question of whether we should set aside Kant’s (...) sexism and racism or ‘translate’ his egalitarian principles into inegalitarian ones. I argue for a third position, namely, that we should highlight the tensions that pervade Kant’s theory. In the final section, I argue that the use of inclusive language and female pronouns in recent discussions of Kant’s moral and political philosophy carries significant risks. I end by articulating several preconditions for fruitfully using Kant’s moral principles to criticize sexism and racism. (shrink)

In this essay, “The Principle of Autonomy in Kant’s Moral Theory: Its Rise and Fall,” Pauline Kleingeld notes that Kant’s Principle of Autonomy, which played a central role in both the Groundwork for the Metaphysics of Morals and the Critique of Practical Reason, disappeared by the time of the Metaphysics of Morals. She argues that its disappearance is due to significant changes in Kant’s political philosophy. The Principle of Autonomy states that one ought to act as if one were (...) giving universal laws through one’s maxims. The criterion of just legislation that Kant accepted in the mid-1780s does not require any actual consent on the part of the citizens—genuine universality is sufficient for a law to be just. Hence, at that time, Kant could indeed explicate the criterion governing the moral permissibility of one’s maxims by drawing an analogy with the criterion governing the justice of political laws. In the Metaphysics of Morals and in other works in the 1790s, however, he added the further condition that laws must be given with the consent of the citizens. With this further condition, the moral criterion was no longer fully analogous to the criterion for political laws being just. Accordingly, Kleingeld argues, Kant dropped the Principle of Autonomy, which was firmly based on that analogy. (shrink)

This article provides a critical discussion of the problems raised by Kant’s characterization of reason as having ‘needs’ and ‘interests’. The first part presents two examples of arguments in which this conative characterization of reason plays a crucial role. The rest of the article consists of a discussion of four different interpretations of Kant's talk of reason as having needs and interests. Having identified a number of problems with literal interpretations of the conative characterization of reason, I examine whether a (...) metaphorical reading, suggested by several commentators, can solve these problems. I argue that it is impossible to regard the conative terms in which Kant describes reason as merely decorative metaphors, and that they are better understood as cases of ‛symbolic exhibition' in Kant's own sense. Kant’s most prominent formulation of the Categorical Imperative, known as the Formula of Universal Law (FUL), is generally thought to demand that one act only on maxims that one can will as universal laws without this generating a contradiction. Kant's view is standardly summarized as requiring the 'universalizability' of one's maxims and described in terms of the distinction between 'contradictions in conception' and 'contradictions in the will'. Focusing on the underappreciated significance of the simultaneity condition included in the FUL, I (...) argue, by contrast, that the principle is better read as requiring that one be able to will two things simultaneously without self-contradiction, namely, that a maxim be one's own and that it be a universal law. What does Plato mean when he declares at Soph. 250b8 that Theaetetus is positing Being in his soul (ἐν τῇ ψυχῇ τιθείς) as a third something encompassing Change and Rest? Is he merely clarifying that the act of positing is a mental act? Or is he making a further point? This paper argues that the locution ‘in the soul’ plays a significant role in the passage in alerting to a contrast between the way Being and its relation to Change and (...) Rest are intelligible to Theaetetus and the way Being really is and relates to those two other kinds. This interpretation is set against another interpretation, defended by Leigh, according to which the phrase should be understood as drawing a contrast between what is done by the agency of the soul and what is done by the agency of the body. The paper then explores the consequences of the proposed interpretation for our understanding of the broader context of the passage. In particular, it argues that the claim that Being is a third something encompassing Change and Rest is more problematic than critics have usually assumed. To account for Theaetetus’ depiction, it develops the notion of ‘conceived parthood’, which are part-whole relations posited by the mind for the needs of a philosophical enquiry. (shrink)

This chapter offers a diagnosis of misconstructions in anti‐humanist feminism and shows how a radical or critical humanism might help to theorize feminism's critical, emancipatory interests. It traces something of the troubled history of modern feminism's relationship with humanism. The chapter suggests that feminism's repudiation has been based on a narrow version; on one that confuses humanism with the rationalist agendas of modern science. It also considers how feminism has rebuilt itself by reinterpreting its critical agendas through the lens provided (...) by critical humanism. Todorov stresses that humanism is concerned with human ways of knowing. He advances three general propositions: that all humans belong to the same species, that they are inherently sociable, and finally that they are essentially indeterminate. Feminism's critical purposes is re‐fashioned and strengthened as it rearticulates its appropriations along with dynamic changes occurring within Enlightenment thinking. (shrink)

In Africa, the Matthaean parable of the talents (Mt 25:14-30) is often used in preaching and in Magisterial texts. On the other hand, the Lucan parable of the mines (Lk 19, 11-28) is less well known. According to the evangelist, Jesus spoke it before entering Jerusalem for his passion, resurrection and ascension. But what does it say in particular about Jesus and the kingdom? How can it be read in an African context? To answer these questions, we will use complementary (...) synchronic, diachronic and contextual approaches. We will do this in four stages. We begin with a synchronic study, presenting the parable itself. We will then move on to a diachronic study, before highlighting some of the theological emphases of the parable and proposing some contextual readings. This paper argues for the hypothesis of direct compositionality (as in, e.g., Montague 1974), according to which the combinatory syntactic rules specify a set of well-formed expressions while the semantic combinatory rules work in tandem to directly supply a model-theoretic interpretation to each expression as it is "built" in the syntax. (This thus obviates the need for any level like LF and, concomitantly, for any rules mapping surface structures to such a level.) I focus here on one related group of (...) phenomena: the interaction of "paycheck" pronouns with Weak Crossover effects and i-within-i effects. These interactions were studied in Jacobson (1977) as they show up in Back-Peters sentences. There I argued that these interactions show that paycheck pronouns have a complex representation at LF; here I show that all of the observations in this earlier work are compatible with the hypothesis of direct compositionality. The key tool is the adoption of a variation-free semantics (a semantics which makes no use of variables as part of the semantic machinery). In addition to the general consequences for the syntax/semantics interface, there are two other main results. First, I provide new arguments for a variable-free semantics. For example, it will be shown that under this view the paycheck reading of a pronoun comes for free; most other theories posit additional mechanisms and/or an additional lexical meaning for pronouns, and thus paycheck and regular pronouns are only accidentally homophonous. Second, I reiterate one of the central points in Jacobson (1977): this is that the first pronoun in a Bach-Peters sentence is indeed a paycheck pronoun, and hence nothing special needs to be said about these sentences nor does any new machinery need to be invoked for them. Dans de nombreux domaines, la transparence s’est imposée comme un élément incontournable. Qu’en est-il de son application à la science, et plus particulièrement à l’expertise scientifique en tant que contexte paradigmatique des relations entre science et société ? En analysant le cas des controverses publiques sur le réchauffement climatique d’origine anthropique, cet article veut souligner les difficultés de mise en œuvre de la transparence pour formuler une éthique de l’expertise et proposer des pistes pour y remédier.

The article re-examines Marx’s liberal period as a contributor to and later as a member of the editorial board of the Rhenish Gazette and the question of the consequences of his liberalism on his transition to socialism. Far from claiming straight away to be the most politically radical of the young Hegelians, the young Marx outlined in his 1842-43 articles a version of moderate republicanism, close to that of Carl von Rotteck. It was by following the gradual distancing of the (...) young Hegelians from liberalism and their concomitant radicalisation, that Marx successively adopted democratic and then socialist positions. This political and theoretical evolution is nonetheless predicated upon the anti-liberal elaboration of what had been a liberal problematic, formulated from 1842 : the question of the autonomy of society relative to the State. It was by way of the critical comprehension of the implications of this demand that Marx gradually arrives at the critique of the constitutional State as an abstract political sphere, and to the defense of a social self-organization for which the requisite is the prior transformation of the activity in question. Se explora cómo el feminismo ha utilizado con éxito la estrategia de la judicialización, logrando que la Suprema Corte de Justicia de la Nación se pronunciara a favor del reconocimiento del derecho de las mujeres y de las personas gestantes a decidir sobre sus cuerpos. El texto se estructura en tres secciones principales. La primera (...) ofrece un marco teórico para entender el creciente protagonismo de las Cortes constitucionales en la toma decisiones que solían ser tomadas por órganos legislativos. La segunda sección repasa algunos hitos clave en la judicialización del aborto, subrayando el papel fundamental de la sociedad civil, tanto a favor como en contra de los derechos reproductivos. This article argues that a fragment from a lost treatise by Abū Bakr al-Rāzī (d. 925) is preserved in the Book on Morphology Kitāb al-Taṣrīf) by Ps-Ǧābir ibn Ḥayyān. Paul Kraus reached the conclusion that the collection to which this book belongs was written between the end of the ninth and the beginning of the tenth century AD. This fragment represents the first attempt – to our knowledge – to analyze the logical structure of sign-based inference in Arabic, which is (...) known as istidlāl bi-al-šāhid ʿalā al-ġāʾib among theologians and philosophers. The author distinguishes between sign-inferences based on homogeneity (al-muǧānasa), course of habit (maǧrā al-ʿāda) and traces (āṯār). After providing a translation of the fragment, the first part of this paper argues that its author is Abū Bakr al-Rāzī. My argument is based on a comparison between this text and a passage from the Doubts About Galen, which is also by Abū Bakr al-Rāzī. I hypothesize that at least two other fragments from the same work or from different works by Abū Bakr al-Rāzī are preserved in the corpus attributed to Ps-Ǧābir. The second part of the paper aims to reconstruct Abū Bakr al-Rāzī’s theory of sign-inference. In so doing, I show the historical influence that Hellenistic debates on sign-inference might have had on al-Rāzī, and I situate al-Rāzī’s theory in the context of the prominent use that the theologians of the kalām made of the istidlāl bi-al-šāhid ʿalā al-ġāʾib. To offer a more comprehensive reconstruction of al-Rāzī’s theory of sign-inference, this article compares the critical approach presented in the newly identified fragment with the epistemological framework outlined in the Doubts About Galen. Finally, this article shows that Abū Bakr al-Rāzī’s theory of sign-inference had a strong influence on al-Fārābī’s logical developments especially in his Epitome of the Prior Analytics, even if he does not acknowledge this intellectual debt. Within Kantian ethics and Kant scholarship, it is widely assumed that autonomy consists in the self-legislation of the principle of morality. In this paper, we challenge this view on both textual and philosophical grounds. We argue that Kant never unequivocally claims that the Moral Law is self-legislated and that he is not philosophically committed to this claim by his overall conception of morality. Instead, the idea of autonomy concerns only substantive moral laws, such as the law that one ought not (...) to lie. We argue that autonomy, thus understood, does not have the paradoxical features widely associated with it. Rather, our account highlights a theoretical option that has been neglected in the current debate on whether Kant is best interpreted as a realist or a constructivist, namely that the Moral Law is an a priori principle of pure practical reason that neither requires nor admits of being grounded in anything else. The Australian Army has adopted “respect” as a new addition to the existing trio of values, “courage, initiative and teamwork.” This article explores what respect may mean as an army value. The significance of respect surrounding two incidents involving Australian Defence Force personnel while on duty in Afghanistan is considered. The first is the so-called “green on blue” attack by an Afghan National Army soldier killing three Australian soldiers on 29 August 2012. The second concerns allegations of mutilation of suspected (...) Afghan insurgents’ corpses by soldiers attached to an Australian Special Forces Unit on 28 April 2013. The incidents have resulted in internal military investigations: in the second incident, with a view to possible prosecution for breach of the law of armed conflict and related disciplinary offences; and in the case of the green on blue attack, leading to a civilian coronial inquest. This article discusses the training and modelling of behaviour required to instil such a value as respect. (shrink)

Background Respect for autonomy is a key principle in bioethics. However, respecting autonomy in practice is complex because most people define themselves and make decisions influenced by a complex network of social relationships. The extent to which individual autonomy operates for each partner within the context of decision-making within marital or similar relationships is largely unexplored. This paper explores issues related to decision-making by couples for health care and the circumstances under which such a practice should be respected as compatible (...) with autonomous decision-making. Discussion We discuss the concept of autonomy as it applies to persons and to actions, human interdependency and gender roles in decision-making, the dynamics and outcomes of couples’ joint decision-making, and the ethics of couples’ joint decision-making. We believe that the extent to which couples’ joint decision-making might be deemed ethically acceptable will vary depending on the context. Given that in many traditional marriages the woman is the less dominant partner, we consider a spectrum of scenarios of couples’ joint decision-making about a woman’s own health care that move from those that are acceptably autonomous to those that are not consistent with respecting the woman’s autonomous decision-making. To the extent that there is evidence that both members of a couple understand a decision, intend it, and that neither completely controls the other, couples’ joint decision-making should be viewed as consistent with the principle of respect for the woman’s autonomy. At the other end of the spectrum are decisions made by the man without the woman’s input, representing domination of one partner by the other. Conclusions We recommend viewing the dynamics of couples’ joint decision-making as existing on a continuum of degrees of autonomy. This continuum-based perspective implies that couples’ joint decision-making should not be taken at face value but should be assessed against the specific cultural, ethnic, and religious backgrounds and personal circumstances of the individuals in question. Descartes, Spinoza and Leibniz stand out among their seventeenth-century contemporaries as the great rationalist philosophers. Each sought to construct a philosophical system in which theological and philosophical foundations serve to explain the physical, mental and moral universe. Through a careful analysis of their work, Pauline Phemister explores the rationalists seminal contribution to the development of modern philosophy. Broad terminological agreement and a shared appreciation of the role of reason in ethics do not mask the very significant disagreements that led (...) to three distinctive philosophical systems: Cartesian dualism, Spinozan monism and Leibnizian pluralism. The clarity of the authors discussion of their key ideas including their views on knowledge, universal languages, the nature of substance and substances, bodies, the relation of mind and body, freedom, and the role of distinct perception and reason in morals will make this book the ideal introduction to rationalist philosophy. RésuméCet article se propose de reconstruire une partie du livre IV du traité perdu Sur la démonstration de Galien à partir des témoignages transmis par Abū Bakr al-Rāzī dans les Doutes sur Galien, et d'une source encore jamais exploitée, la Solution aux Doutes sur Galien de Abū al-ʿAlāʾ ibn Zuhr. L'hypothèse à laquelle nous sommes parvenue est que, dans le livre IV, Galien revient sur le caractère indécidable de la question de l’éternité du monde, et critique la démonstration donnée par (...) Aristote dans le traité Du Ciel, I. Seul un des arguments d'Aristote, qui occupe le court passage I, 3, 270b12–17, lui semble pouvoir être sauvé, car il est fondé sur des indications empiriques. C'est sur ce passage que se concentre al-Rāzī. Cette reconstruction permet de réduire les contradictions entre les fragments du livre IV transmis par Philopon dans Contre Proclus sur l’éternité du monde et le compte rendu d'al-Rāzī. Enfin, cet article montre que si al-Rāzī porte autant d'intérêt à ce passage chez Galien, ce n'est pas seulement à des fins polémiques, mais afin de servir ses propres objectifs philosophico-théologiques. Les objections d'al-Rāzī montrent qu'il considère que la téléologie galénique est adossée à un arrière-fond éternaliste qui ne lui permet pas de reconnaître la primauté de la théodicée pour la cosmologie comme pour la biologie. Después de comparar cuantitativamente los textos de este capítulo con las ediciones de H. Diels y A.H. Coxon, así como de precisar cuáles son los textos "nuevos" que figuran en esta edición y las formas en que los editores decidieron presentarlos, ofrezco algunas consideraciones sobre el concepto mismo de (...) recepción y su operatividad en este capítulo, sobre la superación definitiva de la distinción entre testimonios y fragmentos y sobre las ventajas y desventajas que supone cortar los textos para la presentación esquemática y temática de los contenidos. Por último, examino el modo en que la doctrina de Parménides se presenta en este capítulo y muestro algunas de las decisiones que los autores tomaron sobre los innumerables problemas de transmisión textual del Poema.In this critical note, I will present an analysis of the textual materials that constitute the 19th chapter, dedicated to Parmenides, of the Early Greek Philosophy series by A. Laks and G. Most. After offering a quantitative comparison of the texts in this chapter and the editions of H. Diels and A.H. Coxon, and after specifying which "new" texts figure in this edition and how they are presented, I will provide considerations on the concept of reception and how it operates throughout this chapter, on the definite overcoming of the distinction between testimonia and fragmenta, and on the advantages and disadvantages of cutting out the texts for the schematic and thematic presentation of its contents. Finally, I examine how Parmenides' doctrine is presented and comment on some of the decisions that the authors made on a few of the innumerable problems related to the textual transmission of the Poem. Advance directives convey consumers’ wishes about accepting or refusing future treatment if they become incompetent. They are designed to communicate a competent consumer’s perspective regarding the preferred treatment, should the consumer later become incompetent. There are associated ethical issues for health practitioners and this article considers the features that are relevant to nurses. In New Zealand, consumers have a legal right to use an advance directive that is not limited to life-prolonging care and includes general health procedures. Concerns may arise (...) regarding a consumer’s competence and the document’s validity. Nurses need to understand their legal and professional obligations to comply with an advance directive. What role does a nurse play and what questions arise for a nurse when advance directives are discussed with consumers? This article considers the cultural dimensions, legal boundaries, consumers’ and providers’ perspectives, and the medical and nursing positions in New Zealand. (shrink)

Similarity is central for the definition of concepts in several theories in cognitive psychology. However, similarity encounters several problems which were emphasized by Goodman in 1972. At the end of his article, Goodman banishes similarity from any serious philosophical or scientific investigations. If Goodman is right, theories of concepts based on similarity encounter a huge problem and should be revised entirely. In this paper, we would like to analyze the notion of similarity with some insight from psychological works on analogical (...) cognition. Analogical cognition compares two situations or objects in order to find similarities between them. In doing so, the analogical process sorts the different features of the two situations or objects and determines the most important ones. The analogical process is also highly sensitive to context. Context-sensitivity is desirable at some level, but it is also problematic as it leads to a computational explosion. To answer this problem, we would like to consider salience as a possible heuristic in the analogical process. We will distinguish three forms of salience: Sensory, categorical, and operational. By taking salience into account, we can introduce a shortcut into the computation of similarity and circumvent computational explosion. (shrink)

Visualizations used in the practice of neuroscience, as one example of a scientific practice, can be sorted according to whether they represent (A) actual things, (B) theoretical models, or (C) some integration of these two. In this paper I hypothesize that an assessment of a chain of visual representations from (A) through (C) to (B) (and back again) is used, as part of the practice of scientific judgment, to assess the adequacy of the "working fit" between the theoretical model and (...) the actual thing or process that the model is intended to explain. Many regard Kant’s account of the highest good as a failure. His inclusion of happiness in the highest good, in combination with his claim that it is a duty to promote the highest good, is widely seen as inconsistent. In this essay, I argue that there is a valid argument, based on premises Kant clearly endorses, in defense of his thesis that it is a duty to promote the highest good. I first examine why Kant includes happiness in the highest (...) good at all. On the basis of a discussion of Kant's distinction between 'good' and 'pleasant', and in light of his methodological comments in the second chapter of the Critique of Practical Reason, I explain how Kant’s conception of the good informs his conception of the highest good. I then argue that Kant's inclusion of happiness in the highest good should be understood in light of his claim that it is a duty to promote the happiness of others. In the final section of this essay, I reconstruct Kant’s argument for the claim that it is a duty to promote the highest good and explain in what sense this duty goes beyond observance of the Categorical Imperative. People who wish to end their lives when they consider that they cannot endure further pain and suffering cannot legally obtain help to produce a peaceful death. The reality of practice seems to be that, covertly, physician-assisted suicide and voluntary euthanasia do take place. The value of personal autonomy in issues of consent has been clarified in the courts in that a competent adult person has the right to refuse or choose alternative treatments even if death will be the outcome. The central fact underlying all relations is the question of power and how it can be used to get one's way. When power does not work, we move to compromise. This paper questions the validity of compromise as an effective means of settling differences. My standpoint is that compromise debases relationships, is wrong in principle and does not work in practice either. There is a better strategy: integration, when the contending parties find the wider solution that includes both their interests. (...) Ireland has struggled with its ‘feminine’ identity throughout its history. The so-called ‘chasmic dichotomy of male and female' is embedded in colonial and postcolonial constructions of Irishness and it continues to manifest itself in contemporary cultural representations of Ireland and Irishness. This study explores issues of gender and nationality via a reading of a 70-second television advertisement for Caffrey's Irish Ale, titled ‘New York’. The article suggests that, although colonial and postcolonial discourse on Ireland continues to perceive the ‘feminine’ in (...) problematic terms, this is gradually changing as Irish women increasingly, in poet Eavan Boland's words, ‘open a window on those silences, those false pastorals, those ornamental reductions’ that have confined us. The paradox of phase transitions raises the problem of how to reconcile the fact that we see phase transitions happen in concrete, finite systems around us, with the fact that our best theories—i.e. statistical-mechanical theories of phase transitions—tell us that phase transitions occur only in infinite systems. In this paper we aim to clarify to which extent this paradox is relative to the mathematical framework which is used in these theories, i.e. classical mathematics. To this aim, we will explore the (...) philosophical consequences of adopting constructive instead of classical mathematics in a statistical-mechanical theory of phase transitions. It will be shown that constructive mathematics forces certain ‘de-idealizations’ of such theories: talk of actually infinite systems is meaningless, there are no discontinuous functions, and—in a sense which will be clarified—constructive real numbers reflect our imperfect methods of determining the values of physical quantities. As such, so it will be argued, constructive mathematics offers a means to gain insight in the idealizations introduced in classical theories and the philosophical issues surrounding them. (shrink)

La loi dite Macron du 6 août 2015 introduit pour la première fois dans le Code du travail la notion de « travail en soirée », distincte du travail en journée et du travail de nuit, qui étaient jusque-là les deux seuls horaires journaliers définis juridiquement. À partir d’une analyse approfondie des pratiques nocturnes dans le commerce de détail parisien et des règles négociées sur le travail de nuit dans les entreprises, l’article étudie la sociogenèse de cette nouvelle catégorie juridique (...) afin d’en mesurer la signification et la portée. Il montre que cette invention contribue au processus de colonisation de la nuit, puisqu’elle permet de légaliser une pratique croissante – le travail salarié au-delà de 21 heures dans le commerce – qui était jusque-là illégale et jugée comme telle par les tribunaux.
